Booking terms & Conditions 

This agreement outlines the terms and conditions between the traveler (“you” or “the  guest”) and the travel company Surfing Trip Holidays S.L. under the commercial name  Sunshine Surf Morocco (“we,” “us,” or “the company”) for all bookings made with us.  

By confirming your booking, you acknowledge and agree to the following:

Booking Confirmation: 

  1. A booking is confirmed upon reception of confirmation email with the  booking reference.  
  2. A booking is confirmed only upon receipt of the required 20% deposit  or 30% deposit or full payment, as specified during the booking process. 
  3. A booking confirmation is considered a binding agreement.  
  4. The remaining balance (if applicable) must be paid in cash or credit  card upon check in.  
  5. Acceptance of Terms: By confirming a booking through a third party,  such an agency, or other companies, may be subject to additional terms and conditions specified by the organiser.  

Payment Methods:  

  1. Available payment options: Payments may be made via credit card,  debit card or bank transfer. Any bank transfer or exchange rate fees  will be at the clients expense.  
  2. Currency exchanges. We apply the exchange rate of the day. Currency exchanges may fluctuate between the time of booking and  arrival date. Any significant fluctuations made incur price adjustments  at the clients expense.  
  3. Failure to pay. Surfing Trip Holidays S.L. reserves the right to cancel  the booking without prior notice or charge the credit card on file according to the cancellation policy.  

Cancellation Policy: 

  1. Cancellations must be made in writing and are subject to cancellation  fees based on the proximity to the start date of your booking. 
  2. Refund eligibility and fees will be detailed in your specific package  terms.  
  3. Surfing Trip Holidays S.L. reserves the right to refuse any booking  without providing any reason.

Changes to Booking: 

  1. Changes to your booking are subject to availability and may incur  additional fees* (Please refer to cancellation or reservation change fees section.) 
  2. Changing your dates. We do not guarantee availability for new  requested dates. If there is no mutual agreement on the requested dates, Surfing Trip Holidays reserves the right to apply the cancellation policy fees within the above stated timeline.  
  3. Modifying your stay for the same amount of days. If you wish to change your dates for the same amount of days but different dates, if  there is availability, you can do so up to 30 days prior to your arrival  free of cost. Should there no be any availability, and you wish to cancel, the cancellation policy applies. 
  4. Modifying your stay for a shorter period. If you wish to modify your dates for a shorter period, you can do so up to 30 days prior to your  arrival free of cost. Should there no be any availability, and you wish to cancel, the cancellation policy applies. 

Cancellation or reservation change fees: 

  1. The deposit payment is non-refundable under any circumstances.  
  2. Cancellation between 60 and 42 days prior to arrival will incur in 50%  charge of the total amount of the stay (the deposit will be deducted of  the total amount).  
  3. Cancellations 42 days prior to your arrival will incur a 100% fee  (remaining outstanding balance will be charged on your credit card provided for the deposit payment).  
  4. No show. 100% of the stay excluding taxes will be charged on the credit card provided.  

Refunds: 

  1. Any agreed refunds will be issue via the same payment system:  1. Stripe. Payments with credit card or debit card done via our payment platform will be refunded on the same card provided.  
  2. Bank Transfer. Payments refund via bank transfers may take longer depending on the bank’s policy.  
  3. Refunding fees will be at the client’s expense, unless decided otherwise.  
  4. Refunds may take between 5 to 7 working days from the issuing date.  

Promo Codes & Return Guest Discount: 

  1. Any promo code or Return guest discount is only valid for stays of 7 nights or more. Subject to availability and excluding school holidays.
  2. No discounts are applied to private rooms on single occupancy. 
  3. Return guest discount is only applicable to guests who have visited the previous season (previous season going from September to June). 
  4. The discount is non-transferable, non-accumulative and subject to approval.

Travel Insurance & Liability: 

  1. Mandatory Travel Insurance. All guests must have a full travel insurance covering any medical expenses, trip cancellations and loss of personal property and equipment and any other unforeseen emergencies. 
  2. The company is not liable for any injuries, loss, or damage to property  during the trip. Participation in activities is at your own risk. 

Force Majeure: 

  1. The company is not responsible for disruptions due to events beyond  our control, such as natural disasters, strikes, pandemics, political unrest or other force majeure events. 

Surf and weather conditions:  

  1. No Guarantees: The company cannot guarantee specific weather and  surf conditions and is not liable to the impact of poor conditions and forecast on your activities.  
  2. Activity adjustments: Should the weather or forecast not be favorable  for the practice of certain activities such as surfing, other alternatives will be provided. However, no refunds will be provided if the guests choose not to participate.  

Code of Conduct: 

  1. Guests are expected to respect local customs, staff, and fellow travellers. The company reserves the right to terminate bookings for misconduct without refund should the company deem any behaviour inappropriate.  

Travel Documentation: 

  1. It is your responsibility to ensure you have the necessary documentation, including passports, visas, and vaccination certificates, as applicable. 
  2. The company is not liable for any issues arising from incorrect or missing travel documents.  
  3. If traveling is not possible due to incorrect or missing travel documents, the “no show” cancellation policy fees will be applied.  

Governing Law: These terms and conditions are governed by the laws of Spain. Any  disputes arising under or in connection with these terms & conditions are subject to the  exclusive jurisdiction of the Spanish court.
